IMPORTANT GOVERNMENT ORDERS
Sub: Introduction of New Pension Scheme in the Branch Accounts Offices in the Organization
of PCA (Fys) Kolkata.
Orders/instruction on the subject as received from Ministries/HQrs were circulated from time to time. The latest instruction received from HQrs. Office was circulated under this office Pt I O.O No. AT/22 letter No. Pay/Tech I/0155/Vol-III dated 15.12.2004. It will be seen from there that PCA(Fys) has been declared as the Nodal Controller for consolidation and sending of data to CPAO in respect of defence civilians who have joined service on or after 01.01.2004 and whose pay bill is under the audit jurisdiction of PC of A (Fys) Kolkata/Br. AOs.
To stream line the system of implementation in the organization of PCA (Fys) the following guidelines are issued for implementation and necessary action by all Branch Accounts Offices.
A new cell "New Pension Scheme Cell" will be opened in each BAO. This new cell will act as "Coordinator and Nodal agency" responsible for maintaining all information about recovery of contribution (both individual and Govt.) for IEs/NIEs/NGOs/GOs joining Fy/Allied Estt. on or after 01.01.2004 and whose pay bills are audited and passed for payment by the BAO. The cell will be responsible for collecting all up-to-date information related to rate of Pay, DA, DP, NPA, nominee etc. for above mentioned Defence Civilian employees and forwarding the same to New Pension Scheme Section (NPS Section) of MO.
The NPS cell in BAO will be responsible to ensure that the instruction/ clarification issued by MO are properly implemented.
The NPS Cell will act as I/O agency of EDP Section of the BAO for consolidation of data in magnetic medium. It will be the responsibility of the NPS Cell of BAO to ensure timely submission of data to "NPS Section" in MO.
A Nodal Officer shall be appointed in each Br. AO by the respective Group Controller whose duty will to co-ordinate with different sections of the BAO, NPS Section of MO for proper and timely implementation of the scheme.
Responsibilities of Labour Section
Labour section will be responsible to ensure that Annexure I in respect of all new recruits (IEs) joining service on or after 01.01.2004 is received in triplicate for verification with reference to Factory Part II order. The verified copies will be sent back to NPS Cell for allotment of PPAN.
It will be the responsibility of labour section to ensure that no IE joining on or after 01.01.2004 is paid without recovery of the specified amount. It will be also the responsibility of labour section to ensure that Annexure -II in respect of all IES joining on or after 01.01.2004 are filled in and is completed in all respect. The same, after quoting necessary DV No. and date, is to be handed over to NPS Cell through EDP by due date.
It will also the responsibility of labour section to ensure reconciliation of the amount booked against Code Head for individual contribution and matching Govt. contribution in the punching medium with the amount appearing in CCO-2 and render a certificate to this effect to the New Pension Cell.
It is to be ensured that separate Annexure II are filled in for regular and arrear recoveries made in the same pay bill.

The EDP Section of BAO will enter data relating to Annexure I (General information of the subscriber) and Annexure II (information on monthly recovery). The package for data capture will be provided by EDP Center, MO.
Procedure for allotment of PPAN:
Role of Executive Authority of the Unit/Formation:
Immediate on joining the Govt Service the Unit/Executive authorities will get the Annexure I filled in triplicate from the new entrant. Two copies of application for allotment for PPAN and nomination form (Annexure-I) to be forwarded to respective Pay Audit Office duly countersigned.
In case there is any change in the information furnished in Annexure-I, a change Annexure to be furnished also in duplicate.
Role of Pay Audit Office
The New Pension Scheme Cell will allot PPAN using the algorithm as below :-
Digits 1 - 4 Year.
Digits 5 - 2 for CGDA
Digits 6 - 7 CDA code as used in financial compilation.
Digits 8 -11 Section code as used in financial compilation.
Digits12 -16 running serial number for the year.
One copy of the Annexure I duly endorsing the PPAN number will be returned to the Executive Authority/Unit for keeping in the service record the other copy to be forwarded to New Pension Section of the MO after necessary data entry by the EDP Section.
It is to be ensured that all administrative instructions (like transfer-in transfer-out) in respect of individuals covered by this scheme bear the PPAN.

that “as per orders issued by DOPT, ACP scheme is admissible to all Central
Government employees both industrial and non-industrial”.

Sub : Grant of Night duty allowance to Defence Civilian employees consequent
on implementation of Fifth Pay Commission Recommendations.
Ministry of Defence (Fin/AG) / PB Group to whom the case was referred to by Min.
of Def. / D (Civ-I) has clarified in consultation with DOP&T that since 5th Pay
Commission has recommended statusquo with regard to payment of Night duty
allowance, NDA would continue to be payable based on the revised notional pay of
Rs. 2200/-. For calculation of NDA / Weightage for night duty, apart from the
notional pay, notional increments that an employee would have earned in the
pre-revised scale of pay at the relevant point of time and the notional DA and
CCA as on 31.12.1995.

benefit of payment of Overtime Allowance at double the rate to all
the similarly
placed Para Medical Staff working in Ordnance Factories Hospitals.
Para Medical Staff of Ordnance Factories has been under consideration of the
Government for some time and now the President is pleased to sanction payment of
Overtime wages at double the hourly rate to Para Medical Staff working in the
hospitals of Ordnance Factories to mitigate the discrimination between the Para
Medical Staff working in the hospital and those who work in the dispensary. The
payment at double rate will be made for working beyond the stipulated period
only as per Factories Act.

under Defence Establishment.
Revision of pay scale of civilian Cooks / Head Cooks in Messes, Inspection
Bungalows, etc. outside the canteens (cooks in Army Messes / Cooks in ASC,
Infantry, Ordnance, Signals, etc, Air Force Messes, Ord. Factories Hospitals /
Inspection Bungalow / DSC Lines, etc. and AMC (Units) as under :

The NDA claims may be regulated on the basis of notional pre revised pay as on
31.12.1995 including Compensatory (City) Allowance as admissible on that date
and DA is 148 % as already stands intimated.

Government servants drawing pay up to the stage of Rs. 1030.00 in the existing
scale of or Rs. 775-12-871-14-955-15-1030-20-1150 shall be fixed in S-2 scale of
pay and those drawing pay beyond the stage of Rs. 1,030.00 shall be fixed in S-3
scale of pay.
It has been decided to introduce a new elongated pay scale (to be designated as
S-2A pay scale) of Rs. 2610-60-2910-65-3300-70-4000 in replacement of the
pre-revised pay scale of Rs. 775-12-871-14-955-15-1030-20-1150. In modification
of Note-1 below Rule - 7 of the Central Civil Services (Revised Pay) Rules,
1997, the pay of all Government servants in the pre-revised pay scale of Rs.
775-12-871-14-955-15-1030-20-1150 on or before 01.01.1996 shall be fixed in the
S-2A scale of pay. Re-fixation of pay with effect from January 1, 1996 in the
S-2A pay would result, in a few cases, in the pay of employees being lower than
what had already been fixed in terms of Note-1 below Rule - 7 of eh Central
Civil Services (Revised Pay) Rules, 1997. In order to ensure that pay fixation
in the S-2A pay scale does not result in monetary loss to any of the employees
concerned, it has been further decided that the loss in such cases shall be
protected by the grant of a personal pay equal to the difference between the
pay already fixed and that admissible as a result of re-fixation in the
elongated scale, the personal pay being absorbed in future increments.

Sub : Payment of Time Wage difference to the piece workers who are promoted and those
who got ACP
benefit from August, 1999.
Piece workers who are promoted and those who got ACP benefit from August, 1999
are entitled to difference in the time wages arising out of change in the
upgraded pay scale since after correlation of piece work rates with the pay
scales recommended by 5th CPC, output hours is distributed and no earning.

Sub : Payment of
Incentive Bonus on ACP Pay Scales.
Extract of Point 6 of OFB circular dt. 28.11.2000. Incentive Bonus should be
with reference to the post held by the Industrial Employee on the regular basis
and not with reference to the higher scale of pay granted on up-gradation under
ACP Scheme. The purpose to issue the above clarification was to clarity that
only entitled categories like Semi-Skilled, Skilled and above shall be entitled
for incentive bonus and not unskilled, even if they got ACP scale of skilled.
Entitled categories of employees only shall be eligible to get the incentive
bonus on ACP pay scales. To clarify further an unskilled labour even if in
receipt of Semi-Skilled scale due to ACP, will not be entitled for incentive
bonus as per ACP pay scale of Skilled if he has got ACP to skilled grade.

Sub : Central Civil
Services (Revised Pay) Rules, 1997 - Rectification of anomalies
arising as
a consequence
of fixation of pay in the revised pay scales Supplementary instructions.
The anomaly may be rectified by the grant of an additional increment to the
senior Govt. servant who was drawing a higher pay in a higher pre-revised pay
scale applicable to such feeder posts as compared to their juniors holding
feeder posts included in a different stream or cadre and who wee earlier drawing
pay at an equivalent or lower stage of pay in a lower pre-revised pay scale.
This dispensation shall, however, be applicable only in cases where
the posts involved are clearly distinguishable as feeder and promotion posts
though they may not belong to the same cadre or hierarchy. In other words, this
dispensation shall not be applicable to cases that are attributable only to the
merger of pay scales by the 5th CPC as a measure of rationalization.
Ministries / Departments may kindly take further action accordingly to re-fix
the pay of the effected Govt. servants under their administrative central.

Sub : Assured career progression scheme (ACPS) to employees who have been placed in semi
skilled grade for 2 / 3 years as a Trainee.
DOP&T have offered their comments as under : - “If in respect of skilled trade
recruitment is made against posts sanctioned in the skilled grade (Rs.
3050-4590) but the incumbents are allowed semi skilled grade for first two years
for direct recruit with III/NCUT Certificate or for 3 years for persons who are
promoted from a lower grade after passing the prescribed trade test before they
are placed in the skilled grade, then the semi-skilled grade in such cases may
need to be viewed only as a trainee scale and such placement in the skilled
grade after putting in the specific length of service in the semi-skilled grades
may not be treated as promotion/up gradation and may not be off set against
entitlements under ACP Scheme. However, in respect of trade where posts may be
sanctioned only in semi-skilled grade if any, then regular incumbents of such
posts in semi-skilled grade on promotion to skilled grade, where such avenues
exist will be treated as being appointed on promotion and will not be covered by
the above clarification”.

Sub : Clarification
of CCS (LTC) Rule 1988 regarding suspension
Points raised 1. Whether Govt. servants who seek voluntary
retirement are eligible to avail LTC under the exempted category ? 2. Whether
the Govt. servants who have less than two years service before retirement as on
1st March, 2001 are entitled to avail ALL INDIA LTC block 2002-2005 or Home-town
block 2002-2003 in addition to ALL INDIA block 1998-2001 or Home-town block
2000-2001 ?
Clarifications 1. No. The Govt. servants who will be retiring by
28th Feb., 2003 on attaining the age of superannuation only are eligible for LTC.
2. As per OM dated 2.3.2001, Govt. servants, who have less than two years
service before retirement as on 1st March, 2001 are eligible to avail LTC
provided they have not availed either ALL India LTC block 1998-2001 or Home-town
block 2000-2001which was inforce on the date of issuing the LTC suspension
order. As per rules, one of the said LTC blocks can be availed before 31st
December, 2002. In case the Govt. servants failing under the exempted category
had already availed either ALL India LTC block 1998-2001 or Home-town LTC block
2000-2001 in the year 2000 or subsequent years, no further LTC is permissible to
them.

Sub : Clarification
regarding Emergency Passage Concession to the employees serving in the
N-E Region.
The undersigned is directed to refer to the clarifications sought by various
Ministries / Departments as to whether “Emergency Passage Concession” admissible
to Central Government Employees on posting to N-E. Region in terms of O.M.,
dated 22.7.1998 (Sl. No. 135 of Swamy’s Annual, 1998) would be admissible to
travel to a place other than Home Town , if family is residing at last place of
posting which is not Home Tow of the officer.
2.It is clarified that as per the orders issued by DOP&T vide O.M. No.
31011/3/2001-Estt. (A), dated 31.5.2001 (Sl. No. 262 of Swamy’s new September,
2001) only the Home Town LTC is admissible to Central Govt. employees posted in
North-Eastern Region. The ban will continue to apply in respect of other
concessions such as Emergency Passage Concession or ALL India LTC facility.

purpose of OT wages under section 59
of the Factories Act.
Clause (2) of section 59 of the Factories Act. 19480 provides that ordinary rate
of wages means the basic wages plus such allowance including the cash equivalent
of the advantage accruing through the concessional sale to workers is for the
time being entitled to but does not include a bonus and wages for overtime work.
2.Since the transport allowance has not been excluded from the compensatory
allowance etc. under clause (2) of the section 59 of the Factories Act. 1940 and
hence, Transport Allowance (TA) should be included in the basic rate of wages
for purposed of computation OTA.
